V This joint letter is intended to comply with the requirements of the Amended Scheduling
1 Order and advise you ofthe status of settlement discussions and the progress of discovery. On
A November 3, 2005, Defendant served initial Disclosures on the United States. On December 6,
2005, the United States served Defendant with a Request for Admissions; a response to which was
due on January 9, 2006. On December 9, 2005, the United States served Defendant with a First ·
Request for the Production of Documents and a First Set of Interrogatodes ; responses to which were
due on J anuary 11, 2006. Defendant did not submit any response/objections to any ofthe United
States’ discovery.
Since the Status Conference on October 19, 2005, the parties have not engaged in any
settlement negotiations. The United States plans to Hle a motion for summary judgment by the
deadline set forth in the Amended Scheduling Order.
