The court has considered the Motion to Enlarge Time to File Reply in Support of Motion For Summary Judgment (Doc. # 67), which requests a 30-day extension of Defendants' time to file their reply in support of their Motion for Summary Judgment (Doc. # 59). Numerous and lengthy extensions have been sought for the filing and briefing of dispositive motions. The cumulative effect of these and other delays is that this case is now more than three years old and in violation of the requirement of the Civil Justice Reform Act that civil cases be concluded within three years of filing. Accordingly, by separate order the court is setting a firm trial date of February 21, 2007. The summary judgment briefing must be concluded in time for consideration and ruling by the court and, if the case proceeds, submission of a proposed joint final pretrial statement by January 12, 2007. The Motion to Enlarge Time to File Reply in Support of Motion For Summary Judgment (Doc. # 67) intrudes into the time the court has planned to dispose of the Motion

for Summary Judgment. The Motion to Enlarge will be granted only until November 13, 2006. This time will not be extended further for any reason. IT IS THEREFORE ORDERED that Defendants' Motion to Enlarge Time to File Reply in Support of Motion For Summary Judgment (Doc. # 67) is granted only in part. Defendants' time to file their Reply in support of their Motion for Summary Judgment is extended to November 13, 2006. DATED this 20th day of October 2006.
