Teilborg. Court Reporter: David German Appearances: Angela Marie Wilson-Goodman for plaintiff. Ronald J. Stolkin and Whitney M. Sedwick for defendant. Bench Trial - Day 2 9:05 a.m. Court reconvenes with counsel and plaintiff present. The Court is advised that Dr. Lawrence M. Martin is available to testify telephonically today between 12:00 noon and 2:00 p.m. Same discussed. Court will reconvene after lunch at 12:45 p.m. to take Dr. Martin's testimony. Plaintiff avows that the only documents Dr. Martin will have before him during his testimony are exhibits marked for trial. 9:08 a.m. Mary Csanyi testifies further. Exhibit 24 is admitted into evidence. Over objection of defendant, exhibit 36 is admitted into evidence. Over objection of plaintiff, exhibits 104 and 105 are admitted into evidence. 10:35 a.m. Recess. 12:50 p.m. Reconvene. Plaintiff's witness Dr. Lawrence M. Martin is called to testify out of order and is now sworn and testifies telephonically. Exhibits 13 and 14 are admitted into evidence. The witness is excused. 1:40 p.m. Recess. 1:50 p.m. Reconvene. Plaintiff having no objections, defendant calls witnesses out of order. Nina Barayeva is sworn and testifies. Defendant moves for the admission of exhibit 108. Same argued. The Court sustains plaintiff's objection to said exhibit. The witness is excused. Larisa Baturow is sworn and testifies. Defendant moves for the admission of exhibit 110.

The Court will reconvene for trial on 6/9/06 at 8:15 a.m. Other time reserved to complete trial is 6/13/06 from 8:30 to 10:00 a.m. and 11:00 to 12:00 noon. 4:35 p.m. Recess until 8:15 a.m., 6/9/06.
