Upon Plaintiff's Motion to Continue Trial [82], IT IS ORDERED denying Plaintiff's Motion to Continue Trial [82] for the reasons stated on the record. Plaintiff makes an oral motion for reconsideration of this ruling. Plaintiff's oral motion for reconsideration is denied. Trial shall proceed. 10:12 a.m. Opening statements by plaintiff and defendant. 10:25 a.m. Plaintiff's case: Mary Csanyi is sworn and testifies. Court and counsel discuss trial schedule. 11:55 a.m. Lunch recess. 1:20 pm. Reconvene. Plaintiff's witness schedule is discussed. Witness Jennifer Defilippis now appears by telephone and scheduling a time for her to testify is discussed. Ms. Defilippis is directed to be present in the courtroom at 3:00 p.m. today or, in the alternative, call chambers at 602-322-7560 to testify telephonically. Witness Elaine Rogers now appears by telephone and scheduling a time for her to testify is discussed. Ms. Rogers shall testify telephonically either today before 5:00 p.m. or June 8, 2006 at 8:30 a.m. The deputy clerk shall initiate the call to Ms. Rogers.. Mary Csanyi testifies further.
