COMES NOW, Plaintiff by and through her counsel undersigned, and hereby advises the Court that Plaintiff has elected to revoke the settlement agreement previously entered into between the parties. Pursuant to federal statute, and the language in the General Release Agreement and Covenant Not to Sue, Plaintiff had a period of seven (7) days after signing the Agreement to revoke the settlement in writing, and the Settlement Agreement was not effective or enforceable until the seven-day revocation period expired. Plaintiff signed the Settlement Agreement on May 26, 2006, and she had until June 2, 2006, to revoke the Agreement, which she elected to do on June 2, 2006. On June 2, 2006, Plaintiff signed a Revocation of General Release Agreement and Covenant Not to Sue and it was faxed and mailed to Defendant's counsel via certified mail that same day.
