and Post—Trial Briefs in the above-captioned matter. An extension is sought due to ongoing

discussions between the parties regarding settlement of this action.

2 1 Through a prior stipulation between the parties and a subsequent Court Order dated
2 2 September 22, 2005, the deadline for submission of Proposed Findings of Fact and Conclusions of
23 Law and Post-Trial Briefs is October 31, 2005.1 The parties were to confer and stipulate to a date 1,
24 for oral arguments. The parties hereby stipulate and agree to submit their respective post—trial
