l 7 extension of time to submit their respective Proposed Findings of Fact and Conclusions of Law

and Post-Trial Briefs in the above-captioned matter. An extension is sought due to ongoing

discussions between the parties regarding settlement of this action and holiday vacation plans of

2 1 counsel for the parties.
2 2 Through a prior stipulation between the parties and a subsequent Court Order dated
23 October 28, 2005, the deadline for submission of Proposed Findings of Fact and Conclusions of
2 4 Law and Post-Trial Briefs is November 30, 2005. The parties were to confer and stipulate to a ~
2 5 date for oral arguments. The parties hereby stipulate and agree to submit their respective post-trial
2 6
submission on or before January 13, 2006. Oral argument shall be heard no less than 30 days
