Bentley for defendants and Steve Bryant for defendant Dwight Lankford. 8:35 a.m. Jury trial - Day 4. Court reconvenes with counsel and jury present. Plaintiff's case continues. Charles Davis is sworn and testifies. Joan L. LaFond is sworn and testifies. The witness is excused. Paul Richard is sworn and testifies. Danny L. Wilson is sworn and testifies. The witness is excused. 10:16 a.m. Recess. 10:34 a.m. Reconvene with counsel and jury present. Rudolph Crosswell is sworn and testifies. Robert Carroll is sworn and testifies. Patrick Wehrly is sworn (affirmed) and testifies. Dwight Lankford is sworn and testifies. Mark H. Kuehne is sworn and testifies. The witness is excused. IT IS ORDERED denying Defendants' oral Motion pursuant to Rule 50 for the reasons set forth on the record. The Court specifically finds there was a waiver of any statute of limitation argument not specifically raised in the Final Pretrial Order. IT IS ORDERED denying Plaintiff's oral Motion for Directed Verdict. 4:32 p.m. The jury is now present in the courtroom. Rudolph Crosswell testifies further.
