· DECLARATION of
BRENDA MYER
1. I first met Winnie James in 1978 or 1979 and was a close friend of hers until her death on
April 26, 2006.
2. Many years ago, Winnie confided in me that she kept a diary relating to the problems she
was experiencing with Steven during the period leading to the homicide he and two other
persons committed, and during the year after he was arrested. She also showed me the
diary and permitted me to read some of the entries in it.
3. After Winnie James passed away, her niece and executor, Virginia Brand, left an
assortment of Wimrie’s possessions with me. The possessions were stored in a large box,
and consisted largely of photographs, correspondence and other papers. Many of the
papers were in S" by ll" envelopes. I did not look through these envelopes.
4. Sometime around September or October 2006, I turned over the box of Winnie’s
possessions to Gary Lowenthal, Steven J ames’ lawyer.
5. Recently, l\/Ir. Lowenthal contacted me and asked if I was familiar with Winnie J ames’
handwriting. Although I am not a hand-miting expert, I told him that I have seen many
things Winnie wrote and I am familiar with her handwriting.
6. Mr. Lowenthal informed me that he found what appeared to be Winnie’s diary in one of
the S" by ll" envelopes in the box of Winnie’s belongings. He stated that he had not
knovm of the diary’s existence before this.
7. I explained to Mr. Lowenthal that Winnie had informed me about the diary and had
permitted me to read entries from it. I agreed to look at the diary he had in his possession
to verify that it was Winnie’s.
8. Today, I reviewed a diary that Mr. Lowenthal brought to my house. The handwriting is
W innie’s, and it appears to be the same diary she showed to me previously.
