DECLARATION OP CHELSEA DURKIN
I. I am a law student at Sandra Day O’Connor College of Law at Arizona State
University.
2. I currently am a research assistant for Professor Gary Lowenthal at the law school.
Since September 2006, I have helped Professor Lowenthal with Steven James’
habeas petition.
3. One of my responsibilities was to contact Terry Pillinger, Steven’s attorney at trial
and sentencing, so that Professor Lowenthal could discuss the case with Mr.
Pillinger.
4. On October 27, 2006, I contacted Rebecca Cavender, Mr. Pillinger’s law clerk.
We spoke for about a half-hour on the specifics of the information we were
seeking from Mr. Pillinger, and she told me that she planned to relay this
information to Mr. Pillinger.
5. Subsequent to this conversation, I sent a letter to Ms. Cavender on October 31,
2006, detailing what information we hoped to gain from speaking with Mr.
Pillinger.
6. On November 6, 2006, Ms. Cavender sent me an email informing me that Mr.
Pillinger would not give information regarding Steven’s case. The next day, she
made clear that Mr. Pillinger was declining to talk with myself or Professor
Lowenthal at any time in the future with respect to the case.
7. Since that last correspondence on November 7, 2006, I have not attempted to
contact, nor have I been contacted by, Mr. Pillinger or Ms. Cavender.
