Being first duly sworn, TERRY T. H. PILLINGER, deposes
and says:
I was trial counsel for Steven Craig James in Maricopa
CR—l237ll from May l982 through trial and sentencing in
Trit . November l982. I was admitted to the practice of law in
Q .'4 Arizona in December l975 and have handled approximately
1,000+ criminal cases, among those about SOO felony
» cases. I have tried 2 murder cases and am a certified
criminal specialist.
At my request, prior to trial, Mr. James wrote out for
_ me a complete statement about the events giving rise to
j the charges against him and his participation in them. A
; copy of that statement is attached to this affidavit. In
that statement, Mr. James never mentioned that he had
. taken drugs near or at the time of the offenses. .
Mr. James told me that he did not kill the victim and that
his peripheral involvement was due solely to duress
induced by threats from Lawrence Libberton and Martin A
"` I Norton. 'I'he,first time I remember Mr. James telling me
that he had taken six tablets of L.S.D. was immediately
Tf""' before he took the stand to testify at trial in September
l9B2. I told him that in my professional judgment he
would antagonize the jury by such testimony and that it
- 1 was inconsistent with his announced defense of innocence Z
Q ‘V‘‘ " and coercion. At no time did I te ll him he could not
Q, testify that he was under the influenceof drugs- ...
Even if Mr. James had told me from the outset that he
‘ had ingested drugs shortly before the crimes, I would not
gi have utilized that as a defense because the facts,
;___4_[' including Mr. James' excellent detailed recall about the
" events and everyone's participation in them, would have
L made that defense untenable. In addition, that kind of
E defense would, in my professional opinion, have alienated
ue! the jury.
