` ROSS M. WALLER states under oath as follows:
l. I met Steven James about three to four months before he was arrested for murder in
November 1981.
2. I believe that either Wayne Pace or Dan McIntosh introduced me to Steven James. The
Waller, Pace and McIntosh families were close, and both Wayne and Dan were friends or o
acquaintances of Steven James.
3. I was a friend of Marty Norton at the time. Marty and I liked to go to Steven James’s
trailer to drink beer and do drugs. Sometimes we went together, and sometimes I went
when Marty was not there. Sometimes we brought our girlfriends with us.
4. It seemed to me that Steven James liked Marty and me because he was very generous in
sharing his alcohol and drugs with us.
5. When Steve was awake, he was drinking beer and smoking marijuana much of the time. I
also saw him taking LSD, cocaine, mushrooms and possibly other drugs.
6. The drugs and alcohol affected Steven James’s personality and the way he acted.
Although Steve was always nice to Marty and me, he often got mad other people when he
got drunk or high. He had a difficult time letting go of things that irritated him, and he
would stay agitated well into the next day.
7. Steven James also slept a lot, like a person would if he was really depressed. Steve didn’t
confide in me, so I was never sure of what was bothering him.
8. On the day of the homicide, I was at Steve’s trailer with Marty Norton. We were drinking
all afternoon. I’m not sure who else was there that aftemoon.
9. Marty and I left Steve°s trailer to get something to eat. We decided to "dine & dash” at
Bill Johnson’s Big Apple, which was a few miles away. Steve was pretty plastered when
we left. My own head was swimming, and the walk to the restaurant helped me clear it
somewhat.

lO. Marty and I ordered about $50 worth of food and ate only about S2 of it. We were pretty
out of it at the time. We got caught when we tried to leave without paying, and a police
officer drove us to our homes.
ll. Marty and I agreed to rendevous back at Steve’s trailer after the police left us at our
parents’ home, but my mother watched me carefully that night, keeping me from sneaking
out. It was the luckiest thing that ever happened to me in my life.
l2. I was never contacted by Steven J`ames’s lawyer before his trial or sentencing. I would
have been willing to talk to him and tell the court about all the drugs we were using with
Steven James, because I had nothing to do with the murder. Admitting that I was doing
drugs might have gotten me into trouble, but it was no secret and I would have told the
truth.
