AFFIDAVIT
STATE OF ARIZONA )

DANIEL McI}ITOSH being duly sworn upon his oath,
deposes and says:
1. I reside at 915 W. Cheryl, Apt. #6 in Phoenix, Arizona. This
afidavit is based on personal knowledge of the following facts. All statements
are true and correct to the best of my knowledge and belief.
2. I have known Laurence "Larry" Libberton since we attended
grade school at Heard Elementary. Larry did not have a good relationship with
his father.
3. Larry and I started using drugs in the 8th grade. A friend
taught us how to get high on marijuana. We even used a bong in the
playground. In high school, Larry and I used LSD and pills and experimented
with all types of drugs.
4. Larry and I sold drugs to support our habits.
5. In November 1981, I ran into Larry at a mutual friend’s house.
Larry and I both took drugs and drank nightly for the Eve or six days prior to
and through November 16, 1981. We smoked marijuana, drank beer and
sometimes drank Barcardi 151. On occasion, we were able to get and eat
hashish. A A

6. On Sunday, November 15, Larry and I ate hashish and smoked
pot called "moonbeam green,” which was extremely potent. We also drank
alcohol throughout the day. We drank Budweiser, at least 12 beers each.
7. During Sunday, November 15 and Monday, November 16,
Larry and I partied all day long in Steve James’ trailer. During that time, we
drank alcohol and took drugs.
8. On Monday, November 16, I went to Steven Jarnes’ trailer;
Larry was already there. Martin Norton was also there. A bong and marijuana
were on the table when I arrived. Larry, James and I drank the beer that was at
the trailer and then went out and got more. We each drank about twelve beers
and smoked moonbearn green. We were all pretty drunk and stoned by early
evening. I
9. At approximately sunset Larry, James and I dropped some
acid. I was so wiped·out from the drinking and drugs, I left James’ trailer. A
When I left that night, I was slurring my speech and could hardly walk. Larry
and James were in the same condition, but they did not seem to be as sleepy as I
was. The next morning, Larry and James picked me up in a car and we started
I drinking again.
10. Sometime during the week before James, Larry and Norton
were charged with Maya’s murder, James borrowed a gun from a man who lived
nearby. He was upset because his girlfriend had moved out to live with two
black men. James carried the gun around in a brown bag. He showed the gun
to everyone and waved it at people. A

II. James was physically big and very violent. I explicitly
remember James pulling out Polaroid photographs of gallows he had built. He
told me that he had hung his dog from the gallows.
