Based on the report filed January 9, 2007, at docket 78, the Clerk of Court is directed to refer this matter to United States Magistrate Judge Mark E. Aspey for the purpose of conducting a settlement conference. The parties have specifically requested Judge Aspey. If for some reason, he cannot conduct the conference, then the Clerk shall refer the matter to another magistrate judge.

The parties have also suggested trial dates in April of 2007. Unfortunately, the trial judge is unavailable on either of the suggested dates. Rather than set another date now, the court deems it preferable to await the outcome of the settlement conference. If the case does not settle, then the parties should file another report indicating two more

trial dates that are mutually convenient. The earlier of the dates should be not less than

90 days from the date the report is filed.
