The National Association of Criminal Defense Lawyers ("NACDL") is a non-profit corporation with more than 11,200 members nationwide and 30,000 affiliate members in fifty states, including private criminal defense lawyers, public defenders, and law professors. The NACDL seeks to promote the proper administration of justice and to ensure that the rights to due process and effective counsel, of one's choosing, be preserved in all litigation. The NACDL Lawyers Assistance Strike Force is a Committee of NACDL attorney members who come to the assistance of lawyers who are threatened for providing proper NO. legal representation to a client including the threat of disqualification from representation. Counsel undersigned has reviewed certain pleadings filed in conjunction with this matter. A generalized claim is raised that the government believes that there may be a conflict of interest in this matter. If the government truly believes that a conflict of interest exists based upon proper evidence, it has a duty to come forward and to raise it with the Court. If the government does not believe that there are proper facts supporting such a claim, these types of issues should not be raised even indirectly because of the potentially harmful effect they have on an attorney/client relationship. They are also wasteful of the Court's time. If the government squarely raises a conflict of interest issue, counsel undersigned will respectfully seek leave of this Court to intervene on behalf of the law firm and the NACDL in that matter.
