AND RELATED COUNTERCLAIMS AND THIRD PARTY CLAIMS Pursuant to Local Rule 7.2(g), Plaintiff Meritage moves the Court to reconsider its Minute Entry of June 1, 2007, when it denied Meritage's Motion for Leave to Supplement Statements of Fact Opposing Defendants' Motions for Summary Judgment. Meritage files this motion for reconsideration out of abundance of caution and to ensure that the record on summary judgment is complete. In its ruling, the Court stated that there was no "compelling reason" to allow

supplementation of the summary judgment record.
However, we believe that the
"compelling reason" standard is not the appropriate standard and that Meritage, as the opposing party, is entitled to supplement the record under Rule 56(c), Federal Rules of Civil Procedure. That Rule provides that "[t]he adverse party [the party opposing
summary judgment] prior to the day of hearing may serve opposing affidavits." There had been no summary judgment hearing when Meritage submitted the sworn Declarations of Kelly Brassfield and Ellen Elford on May 24, 2007. As of the date of this filing, there has been no hearing on the motion, and none has been set. As such, the proposed supplementation by Meritage was timely under Rule 56(c). Meritage
