The Court earlier admonished Meritage not to file submissions exceeding page limitations contemporaneously with a request to be permitted to exceed those limits. This filing is no different in principle. The Motion For Leave just assumes it will be granted, and contemporaneously submits and argues the purported evidence. In fact, the Motion should be denied. Discovery has long been closed, the Court was explicit about the time and page limitations of the final summary judgment submissions, and this submission is entirely untimely. If this conduct is permitted, Meritage will further pilfer its shareholders' pockets with seriatim filings until the Court enters its summary judgment decision. The Court should deny the Motion and ignore the precipitately submitted evidence. Respectfully submitted this 24th day of May, 2007.
