Once again Meritage has displayed its disdain for the Court's instructions, this time by filing the Declaration of Ellen Elford. Long after the time limit for summary judgment submissions, Meritage files a document which can only be interpreted as a belated attempt to bolster its lame claim that there was consumer confusion between "Rick Hancock Homes" and "Meritage Hancock Communities." Not only is the Declaration incredible on its face, it is time-barred under the Court's summary judgment briefing Order, and should be ignored. Moreover, Meritage should suffer consequences determined by the Court to punish its audacity in even making the filing. Respectfully submitted this 24th day of May, 2007.
