SETTLEMENT MAGISTRATE

Defendant First Capital Group (" First Capital" ), by and through its counsel , does request
pursuant to D. C.COLO. LCivR 16. 6 that this matter be assigned to a U.S. Magistrate for a

settlement conference. As grounds therefore the defendant does state:

That during the last two years there has been a settlement conference before Judge Stephen Briggs of the Judicial Arbiter Group and some further nonproductive ongoing settlement negotiations. Despite these efforts no settlement of this action has been achieved.

That First Capital is of the opinion that a settlement conference before aU. S. Magistrate at which all parties and their counsel are required to attend might produce meaningful settlement negotiations or would prove that settlement is not possible and the matter will have to be tried.
This it is desirable that such a conference be held before the pre-trial conference that is set for Friday, October 7 2005 at 10:00 a.

This matter has been pending since October 11 , 2001.

takes no position as counsel for National Union has not had a chance to confer with their client. Gruppuso s counsel advises that they have no objection to the motion but they will ask the court to be excused from attending the conference since they have no ability to contribute to any settlement.

WHREFORE , defendant First Capital requests that the Court order that a settlement conference be held before the U. S. Magistrate Judge.
