JOINT STATUS REPORT Pursuant to this Court's June 2, 2008 Order, the parties respectfully submit this Joint Status Report. The parties are currently attempting to resolve this case through settlement. The parties initially scheduled a mediation for the week of June 16, 2008 but had to reschedule due to a conflict with the mediator's schedule.1 The parties then scheduled the mediation for the last week of July, but had to reschedule again because plaintiff's principal was called out of the country and will not return until September. The parties are currently scheduling the mediation for September. Accordingly, the parties respectfully request that they be permitted to continue settlement discussions and submit an updated joint status report on or before September 31, 2008. Should the parties reach an impasse in negotiations prior to that time, we will notify the Court.

The parties have selected Judge Donald Ziegler as the mediator. Judge Ziegler is the former Chief Judge for the United States District Court for the Western District of Pennsylvania.
