JOINT STATUS REPORT Pursuant to this Court's January 23, 2008 Order, the parties respectfully submit this Joint Status Report. The parties are currently attempting to resolve this case through settlement. Counsel have tentatively agreed to utilize alternative dispute resolution to facilitate resolution of this matter. Consistent with that tentative agreement, counsel for the United States is currently seeking authority to participate in alternative dispute resolution. Assuming that authority is granted, the parties anticipate utilizing a private mediator to attempt to resolve this case.
