No. 01-642 C (Filed: February 25, 2008) ************************************* GASA, INC., * * Plaintiff, * * v. * * THE UNITED STATES, * * Defendant. * ************************************* ORDER On February 21, 2008, the parties in the above-captioned case filed a Joint Status Report, indicating that they are "attempting to resolve the case through settlement." The parties have tentatively agreed to use alternative dispute resolution to facilitate a settlement, and, if defense counsel obtains approval, anticipate using a private mediator. The court is pleased that the parties have continued in their efforts to reach a settlement in this matter. The parties shall file a joint status report, no later than Friday, May 30, 2008, indicating the progress of their settlement discussions. However, if the parties reach an impasse in their discussions before that date, they shall file a joint status report within two weeks of the impasse suggesting further proceedings in the case. Further, if at any time the parties wish to pursue alternative dispute resolution using a settlement judge (see RCFC Appendix H), they shall file a joint status report indicating that fact and the court will then make the appropriate arrangements. IT IS SO ORDERED.
