JOINT SCHEDULING PROPOSAL In light of the Court's cancellation of the August 1, 2007 status conference in this matter, the parties respectfully propose the following post-trial schedule: Plaintiff's opening post-trial brief due November 12, 2007. Government's opening post-trial brief due January 14, 2008. Plaintiff's rebuttal due February 11, 2008. Government's sur-rebuttal due March 10, 2008. We note that this proposed schedule is based upon the expectation that the current search for additional documents being undertaken by the Federal Bureau of Investigation ("the FBI") at the Court's direction will yield no further material documents. If that search should discover new documents judged by plaintiff to be material, the parties will so inform the Court and propose changes to the schedule that they deem appropriate.1 Respectfully submitted, PETER D. Regardless of the results of the search, upon its conclusion, the Government will file with the Court a declaration detailing the FBI's efforts.
