DEFENDANT'S STATUS REPORT REGARDING ADDITIONAL DOCUMENTS On June 20, 2007, the last day of the trial in this case, the Court directed the Government to renew its investigation regarding the existence of certain documents and prepare declarations from those conducting the search to report the efforts that they made to find the documents. Because we were uncertain of the exact amount of time necessary for such a comprehensive search, we requested, and the Court agreed, that the Government be permitted to submit this status report, which would propose a date for the Government to comply with the Court's directive. The Drug Enforcement Agency has subsequently renewed its search for the questioned documents (primarily "SARC committee" minutes and documents related to an Attorney General's exemption in the Princess case). We believe that a comprehensive new search for such documents will be completed within four weeks of this status report, i.e., July 27, 2007. In the meantime, as directed by the Court, we have secured a copy of the letter by Special Agent in Charge Cash, that was referenced as Attachment 8 to Plaintiff's Exhibit 94. That letter is attached, in electronic form, to this status report. We have also discussed a proposed post-trial briefing schedule with counsel for plaintiff. Although the parties are in general agreement regarding the schedule, we believe it best to wait

until the Government has completed its new search for documents before proposing a schedule to the Court because, should unanticipated additional documents be found, they could potentially affect the time needed by the parties to brief this case.
