DEFENDANT'S FOURTH STATUS REPORT Pursuant to this Court's Order dated January 27, 2006, defendant respectfully submits this fourth status report. The contents of this report have been discussed with counsel for plaintiff. Counsel for plaintiff has stated that he has no objection to the filing of this report. On December 20, 2005, the parties met to discuss the possible resolution of the case. Plaintiff's formal written offer to settle this matter has been accepted upon behalf of the Government. Upon execution of the Settlement Agreement, plaintiff will execute a stipulation of dismissal in this action with prejudice to be filed with the Court after plaintiff receives payment pursuant to the Settlement Agreement.
