DEFENDANT'S STATUS REPORT Pursuant to this Court's Order dated November 1, 2005, defendant respectfully submits this status report. The contents of this report has been discussed with counsel for plaintiff. Counsel for plaintiff has stated that he has no objection to the filing of this report. On December 20, 2005, the parties have agreed to meet to discuss the possible resolution of the case. In attendance at that meeting will be representatives of the parties, as well as personnel familiar with the technical matters at issue in the case. Also in attendance will be the Government's expert. Counsel for the parties will file a status report with the Court regarding status of the settlement negotiations no later than December 27, 2005.
