DEFENDANT'S SECOND STATUS REPORT Pursuant to this Court's Order dated November 1, 2005, defendant respectfully submits this second status report. The contents of this report have been discussed with counsel for plaintiff. Counsel for plaintiff has stated that he has no objection to the filing of this report. On December 20, 2005, the parties met to discuss the possible resolution of the case. In attendance at that meeting were representatives of the parties, as well as personnel familiar with the technical matters at issue in the case. Also in attendance was the Government's mechanical engineering expert. Counsel for the parties are in the process of finalizing a tentative settlement agreement, including seeking the necessary authorizations to resolve this matter.
