DEFENDANT'S THIRD STATUS REPORT Pursuant to our representation contained in our second status report, defendant respectfully submits this third status report. The contents of this report have been discussed with counsel for plaintiff. Counsel for plaintiff has stated that he has no objection to the filing of this report. On December 20, 2005, the parties met to discuss the possible resolution of the case. In attendance at that meeting were representatives of the parties, as well as personnel familiar with the technical matters at issue in the case. Also in attendance was the Government's mechanical engineering expert. Plaintiff has made a formal written offer to settle this matter. The Government is currently evaluating that offer. Defendant will file a status report with the Court regarding the status of the settlement negotiations no later than January 31, 2006. Respectfully submitted, PETER D.
