ORDER The Court received the parties' Joint Status Report ("JSR"), filed on September 6, 2006, requesting more time to finalize their selection of representative plaintiffs from a medium-sized facility. (The parties previously informed the Court, in their JSR filed on August 7, 2006, that they have agreed upon representative plaintiffs from small-sized and large-sized facilities.) This is the fifth JSR the Court has received from the parties, since May 19, 2006, regarding the selection of representative plaintiffs and facilities, each requesting more time to agree upon a final list of representative plaintiffs and facilities. The Court is pleased to have been informed, in the most recent JSR, that the parties have commenced settlement negotiations. However, the Court wants to emphasize that any settlement discussions are to be held concurrently with the scheduled discovery and will not be allowed, in the meantime, to impair progress toward a resolution of this case through litigation. Accordingly, the Court reminds the parties, settlement negotiations notwithstanding, that it is not inclined to extend the time period for fact discovery. It is hereby ORDERED that the parties file a JSR on or before October 20, 2006, that provides a complete and final list of all representative plaintiffs and facilities.
