JOINT STATUS REPORT Pursuant to the Court's August 15, 2006 order, the parties respectfully submit this joint status report concerning the status of their efforts to select representative plaintiffs. The parties have not yet been able to agree upon representative plaintiffs from a medium sized facility. However, defendant has received a settlement proposal from the plaintiffs which defendant intends to submit to the authorized representative of the Attorney General with a recommendation. If the offer is accepted, this will obviate the need to select representative plaintiffs. Accordingly, the parties request that the Court enter an order directing the parties to file a joint status report advising the Court of the status of this matter on October 20, 2006.
