**************************** ____________________________________________________________________________ ORDER GRANTING DEFENDANT'S MOTION TO AMEND ANSWER AND FILE COUNTERCLAIMS AND PLAINTIFF'S MOTION TO AMEND SCHEDULE _____________________________________________________________________________ On July 16, 2007, Plaintiff filed an unopposed motion for enlargement of time and a notice that it does not oppose Defendant's motion to amend answer and to add counterclaims.1 Defendant's motion for leave to amend answer and add counterclaims is GRANTED. Defendant's amended answer with counterclaims is accepted for filing this date. Plaintiff requests an enlargement of time of 120 days to conduct written discovery, and additional time to complete depositions. Plaintiff's motion for an enlargement of time is GRANTED. The Court amends the schedule as follows: 1. 2. November 13, 2007 January 9, 2008 Written fact discovery shall be concluded. All depositions of fact witnesses shall be completed.

On May 17, 2007, Defendant filed a motion to amend its answer and assert affirmative defenses and counterclaims based upon the False Claims Act., 31 U.S.C. § 3729 et seq., the special plea in fraud, 28 U.S.C § 2514, and the fraud provision of the Contract Disputes Act ("CDA"), 41 U.S.C. § 604.
