_________________________________________ PRELIMINARY SCHEDULING ORDER __________________________________________ Pursuant to United States Court of Federal Claims Rule (RCFC) 16(b), the Court held a conference with the parties on October 18, 2006, to set a schedule for discovery and the filing of dispositive motions. In accordance with the representations made by the parties, the Court schedules the following: 1. Written Fact Discovery. All written fact discovery shall conclude on or before February 28, 2007. Deposition of Fact Witnesses. All depositions of fact witnesses shall be completed by April 30, 2007. In order to achieve this deadline, the parties shall make witnesses available for deposition at reasonably convenient locations and times. The parties are reminded that the rules of the Court contemplate the use of depositions at trial for testimonial purposes in certain circumstances "as though the witness were then present and testifying. . . ." See RCFC 32(a). Dispositive Motions. Defendant shall file any dispositive motion on or before May 18, 2007. Plaintiff's response and/or cross-motion shall be filed on or before June 15, 2007, and Defendant shall file its reply on or before July 6, 2007. Plaintiff shall file its reply on or before July 20, 2007.

Telephonic Conference. A telephonic status conference has been scheduled for May 8, 2007, at 11:00 a.m. EST. The parties are also urged to contact the court to request a telephonic conference at any time when they believe the involvement of the court will help to secure the just, speedy and inexpensive determination of this action. See RCFC 1.
