favor on ali counts ofthe piaintiif`s' Amended Complaint directed to Westfield
I! Shoppingtovvn Trurnbuii. As is more particuiarly set forth in the memorandtun of law E
tiled in support of this motion, under the undisputed facts set forth in Westfield
Shoppingtown TrumbulE's Rule 56{a} Statement and the Affidavit of Len lvfaenza, A
Westfield Shoppingtovvn is entitled to judgment as a matter of law because: (3} no
representative of Westfieid Sboppingtown Trunthull was present at the time ofthe
incident atieged in the plaintiffs compiaint and there is no basis upon which liability
I may be imposed against Westfieid Shoppingtotvn Truntbutl for the alleged acts ofthe
codefendants; {2} plaintiffs cannot recover damages under 42 U.S.C. §2tI{}I]a because
Westfield Shoppingtovm Trumbull, a privately ovmed mall on private property, is not a I

place of public accommodation; [3) plaintiffs failed to exhaust any applicable E I
administrative remedies under 42 U.S.C §2t}=U[la prior to commencing this action; [4)
plaintiffs can not satisfy the elements necessary to establish a prima facie ease of § r
u l
discrimination under 42 U.S.C. §l93l; (5) plaintiffs can not satisfy the elements I
necessary to establish a prima facie case of conspiracy to discriminate under 42 U.S.C. E
§§l9S5 and 1936; and, {6) there are no facts to support plaintiffs' claims that Westtield I
Shoppingtovrn Trumbull is liable to them for false imprisonment. For all of these
II reasons, Westtleld Shoppingtown Trumbull is entitled tojudgment as a matter of law. I
In support of this motion, Westfield Shoppingtown Trumbull tiles the
following: (1} a Rule 56[a) statement of material facts that Westfield Shoppingtown if
Trumbull submits are undisputed; (2} an Aflidavit of Len Maenza, General Manager of
Westtield Shoppingtosvn Trumbull at the time ofthe incident referenced in the
plaintit`fs' Amended Complaint; and, {3] a memorandum of law in support of Westfield I
II Shoppingtown 'l`rumbull's motion for summary judgnent.
WHEREFGRE, the defendant Westtield Shoppingtovm Trumbull, respectfully I
requests that its motion be granted and that the Court enter an order ot` summary {
judgment in its favor.
