Dear Veronica:
I write in response to your letter of today’s date regarding production of source code.
I understand that you are reserving your argument that the disks in question may not
contain source code owned by Lexcel. I have described the disks ads containing Lexcel code
because your client testified yesterday that he received those disks from Alec Dollarhide, who i
told him that they were Lexcel disks.
Regardless, the issue is production of these disks, which your client and your expert have.
, The only basis for your refusal to produce the disks is Lexcel’s confidentiality interest (another
reason for my labeling the disks in question as Lexcel’s). Lexcel has now agreed to allow Q
production of these disks pursuant to the conditions in my letter of today. I
By copy of this letter, I am asking Ms. Curtin to confirm this in writing to you. i
Finally, given your client’s testimony I am at a loss as to how my prior letter "absolutely A
misstates the truth." That assertion is wrong. Please do not send me a letter like that again. j
