Upon the stipulation of the parties and good cause appearing,

dismissed with prejudice:

1. Robert E. Moroney LLC's and Robert E. Moroney‘s (collectively "REM")

Second Claim forRelief for intentional interference with prospective economic advantage,

Third Claim for Relief for defamation, Fourth Claim for Relief for business
27
disparagementftrade libel and Fifth Claim for Relief for aidingand abetting tortious
28
conduct all raised against Erchonia Medical, Inc. ("Erchonia"), Steven and Debbie Sue
Shanks, George and Gina Leger, a.nd Kevin and Carolyn Tucek. REM‘s First Claim for

1 Relief for false advertising is limited to the Leger shock hazard memo and its Seventh
2 Claim for Relief for violation of Arizona's Consumer Fraud Act is limited to Erchonia's.
3 sale of Biocleanse footbath products to REM and the Leger shock hazard memo.
4 2. Erchonia's- First Dlaim for Relief for trade secret misappropriation and
5 Seventh Claim for Relief for.]-,anham Act unfair competition against REM.
` 6 IT IS ALSO ORDERED,ADJUDGED AND DECREED that George Leger shall
7 remain bound by the Preliminary Injunction is sued in this action and shall be b ound by any
S injunction issued against Erchonia concerning the George Leger memo, as if he were a
9 person acting in concert with Erchonia.
10 ITIS FURTHER ORDERED, ADJUD GED AND DECREED that each party shall
11 bear its own costs and attorneys' fees afociated with the above—stated causes of action.
