The Court having received the Stipulation to Dismiss Erchonia's Claims Against Defendants Gonzalez and Guzman Only and Related Counterclaims, and good cause appearing, IT IS ORDERED, that all claims and counterclaims now pending in this action between Erchonia Medical Inc. ("Erchonia") and Kevin Tucek, on the one hand, and George Gonzalez and Lorena Guzman, on the other hand, are dismissed with prejudice, each side to bear their own costs and attorneys' fees. Nothing in this Order shall be construed to dismiss or limit any claims Erchonia, Tucek, Gonzalez or Guzman may have against any other party in this action. DATED this 7th day of September, 2005.
