1 Defendant, Erchonia Medical Inc., through its undersigned attorneys, requests
2 this Court to extend the time for Erchonia to file its Response to REM’s Motion for
3 Summary Judgment regarding UCC and Arizona Consumer Fraud Act claims.
4 Erchonia’s Response was due Monday, August 22, 2005. Considerable amount of work
5 regarding the motion was completed well before that time; however, the lawyers for
6 Erchonia had difficulty in executing what turned out to be their first e-filing matter. As
7 a result, Erchonia’s lawyers were not able to file the Response until Tuesday, August
8 23, 2005. For these reasons, Erchonia asks for a single day extension through and
9 including August 23, 2005, in which to file their Response. Erchonia further requests
10 this Court to accept their Response for the reasons explained. The undersigned has
11 personally spoken to REM’s Denver attorney, Ben Lieb, who indicates he has no
12 opposition to this request as long as REM’s time for filing a reply is calculated from
13 August 23, 2005. Under the circumstances, Erchonia has no opposition to that
14 reasonable request.
15 For all the reasons expressed herein, Erchonia requests a single day extension for
16 the submission of their Response. Erchonia requests the Court to accept their Response
17 as filed. ‘
