REPLY IN FURTHER SUPPORT OF ROBERT E. MORONEY LLC'S CONSOLIDATED MOTION FOR PARTIAL SUMMARY JUDGMENT REGARDING: (1) BREACH OF IMPLIED WARRANTY OF MERCHANTABILITY; (2) BREACH OF IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE; AND (3) VIOLATION OF THE ARIZONA CONSUMER FRAUD ACT

Robert Moroney ("Moroney") and Robert E. Moroney LLC (collectively "REM"), 28 hereby replies in further support of its Consolidated Motion for Partial Summary Judgment Regarding: (1) Breach of Implied Warranty of Merchantability; (2) Breach of Implied Case 2:02-cv-02036-MHM Document 304 Filed 09/09/2005 Page 1 of 4

Warranty of Fitness for a Particular Purpose; and (3) Violation of the Arizona Consumer Fraud Act (the "Motion"). REM believes that Erchonia Medical, Inc.'s ("Erchonia") Response to the Motion does not raise any genuine issues of material fact concerning any of the required elements of proof for each of the claims at issue. Therefore, REM is entitled to summary judgment for the reasons set forth in its opening Brief. Further, although REM disputes many of the facts alleged by Erchonia in support of its Response, those allegations (if admissible) are not relevant to the determination of REM's Motion. Thus, in order to preserve its resources, REM does not respond to Erchonia's factual allegations at this time.1 For the reasons set forth in REM's Motion, REM respectfully requests that the Court grant partial summary judgment to REM on its claims for breach of warranty of merchantability and fitness for a particular purpose, and violation of the Arizona Consumer Fraud Act.
