1 Erchonia Medical Inc., Steven W. Shanks, and Kevin and Carolyn Tucek
2 ("Erchonia"), through their undersigned attorneys, request this Court to enter an Order
3 to correct two apparent typos contained in the Court’s Order conceming various motions
4 for summary judgment filed by several different parties in this action. (Doc. No. 318.)
5 Erchonia believes that the tirst typo appears at page 22, line 23, in a sentence which
6 reads, "In 1999, Mr. Shanks moved to Arizona, began attending the Grace Baptist
7 Church, and began working as the Vice President of Sales and Marketing for Erchonia."
8 Erchonia believes that "Mr. Shanks” should be changed to “Mr. Smith" in that sentence.
9 Erchonia believes that the second typo appears at page 27, line ll, in a sentence which
10 reads, "Instead the relationship between Mrs. Winner and Erchonia was that of
11 debtor/creditor." Erchonia believes that "Erchonia" should be changed to "REM" in
12 that sentence.
13 Erchonia makes this request to correct the apparent typo pursuant to Rule 60(a),
14 Federal Rules of Civil Procedure, which affords the Court the discretion to correct any
15 form of "clerical mistake" upon the Court’s own initiative or upon motion of any of the
16 parties.
