1 2. On January ll, 2006, I received an e-mail notification from FreeERISA that the
2 most recent data release from the Department of Labor had been updated and was available to
3 the general public on the Internet. (Exhibit l)
4 3. Subsequent to the FreeERISA notification, I downloaded a copy of the Form
5 5500 for plan year ending 2004 (PYE 2004) filed by the Brewer retirement plan.] A true copy
6 of that form is attached as Exhibit 2 to my declaration.
7 4. Form 5500 for PYE 2004 was electronically filed by the Brewer retirement plan
8 and as such does not bear a physical signature, but is required to represent complete and
9 truthful answers to the questions on the form rmder penalty of perjury.
1() 5. Documents produced in the course of discovery identify fifteen (I5) participants
ll in the Brewer retirement plan(s), including myself. (Exhibit 3)
12 6. Form 5500 for PYE 2004 reported fifteen (15) participants at the beginning of
13 the plan year. (Exhibit 2, line 6)
14 7. Defendants determined that participant C. Robert Brewer was ineligible to
15 receive benefits (Exhibit 4); therefore, Form 5500 for PYE 2004 correctly reported two (2)
16 active and twelve (12) separated participants entitled to receive future benefits. (Exhibit 2,
17 lines 7a, 7c)
18 8. Form 5500 for PYE 2004 reported fourteen (I4) participants with account
19 balances as of the end of the plan year. (Exhibit 2, line 7g)
2() 9. The last distribution I received from the Brewer retirement plan was on May l3,
21 2004, more than six months prior to the end of the plan year. (Exhibit 5)
22 l0. I declare under penalty of perjury that the foregoing is true and correct.
