21 On September 26, 2005, Plaintiff Hied a motion requesting a settlement conference
22 under Fed. R. Civ. P. 16(a)(5). Rule 16(a)(5) permits the court to “direct the attomeys for the
23 parties to appear before it for a conference or conferences before trial for such purposes
24 as {fl] facilitating the settlement ofthe case." On October 14, 2005, Defendants filed notice
25 that they do not oppose Plaintiffs motion. Accordingly, the Court GRANTS Plaintiffs motion
26 for a settlement conference.
27 An order entered on November 9, 2005 bythe Honorable Stephen M. lx/lcNamee, Chief
28 Judge of the District of Arizona, and the Honorable Irma E. Gonzalez, Chief Judge of the
Southern District of California, assigned the Honorable Leo S. Papas, Magistrate Judge ofthe
