18 Pursuant to 28 U.S.C. § 292 (d), the Chief Judge ofthe Ninth Circuit designated the
lg Honorable Barry Ted Moskowitz of the Southern District of California to hear the above
20 captioned case. The designation of an out-of-districtjudge was made on the request of the
21 Chief Judge of the District of Arizona based on the fact that the judge then assigned to the
22 case had recused and there was a substantial likelihood that the otherjudges in the district
23 would recuse themselves. The same circumstance exists as to Magistrate Judges in the
24 District of Arizona. Therefore, pursuant to 28 U.S.C. § 636(f), given that the emergency
25 requiring assignment of an out-of-district judge applies equally to the assignment of a
26 magistrate judge, it is hereby ordered that the Honorable Leo S. Papas, Magistrate Judge
27 of the Southern District of California, is temporarily assigned to conduct pretrial matters
28 including settlement conferences in the above captioned case as provided for in 28 U.S.C.

1 § 636(b)(1)(A). The assignment will end upon the entry of tina! judgment in the case.
