3 I, Stuart J. Reilly, declare:
4 1. I am the Plaintiff in the cause of action entitled Reilly v. Charles M Brewer, Ltd
5 Profit Sharing Plan and Trust, et al., in the United States District Court, District of Arizona,
6 Case No. CIV 02-2218 PHX EHC.
7 2. I have no recollection of any requests by Defendants regarding a settlement
8 conference or mediation prior to June 2, 2005.
9 3. I expressed no opinion as to whether or not Defendants’ $100,000 settlement offer
10 was made in good faith.
ll 4. On June 2, 2005 I conferred with Mr. Vanic regarding which discovery documents
12 would be used at trial.
13 5. On June 2, 2005 I verbally expressed my displeasure at the uselessness of the heavily
14 redacted documents Defendants had produced pursuant to Judge Carroll’s order and requested
15 unredacted copies.
16 6. I was unable to set forth a specific demand amount in my July 1, 2005 settlement
17 letter because Defendants had not yet provided the requested financial data to make that calculation.
18 7. I did not tell Mr. Vanic that I would retum the signed mediation agreement to
19 Mr. Krivis.
20 8. I declare under penalty of perjury that the foregoing is true and correct.
