After exhaustive pretrial issues and an extended bench trial, Judgment was entered in favor of Defendant. Plaintiff's claims, concerning his termination, while unsuccessful, were meritorious. The actions of Plaintiff's immediate supervisor and his testimony at trial as well as activities of Defendant's HR Department presented substantial issues for the Court to resolve. Defendant prevailed under a preponderance of evidence standard, i.e., the slightest tipping of the scales of justice.

The Court awarded a Judgment in favor of Defendant in the amount of $955.00 on January 19, 2007 related to a rental obligation Plaintiff had in Tucson. Plaintiff's family was living in Tempe at this time and the claimed relocation expenses was the basis for a criminal action precipitated by Defendant in the Maricopa County Superior Court. In that proceeding Plaintiff paid Defendant more than $7,000 related to relocation claims previously paid by Defendant. On February 1, 2007 Defendant filed a Motion for Attorneys' fees for recovering the Judgment of $955.00. Plaintiff filed an "Objection" to Defendant's Bill of Costs and Motion for Reconsideration of the $955.00 damage award. On March 16, 2007 Defendant filed a Memorandum requesting $4,814.37 related to recovering the $955.00 damage award. Plaintiff responded to the motion and Defendant filed a reply. The Motion was heard August 10, 2007 and is pending decision by the Court. The Court, being fully advised, IT IS ORDERED granting Plaintiff's Motion for Reconsideration of the $955.00 damage judgment; IT IS FURTHER ORDERED vacating and setting aside the $955.00 Judgment ; IT IS FURTHER ORDERED vacating and setting aside paragraphs 22-27 and admission of any exhibits related to breach of contract and fraud/deceit; IT IS FURTHER ORDERED denying Plaintiff's Objection to Defendant's Bill of Costs; IT IS FURTHER ORDERED denying Defendant's Motion for Attorneys' fees filed February 1, 2007 as moot.
