(hereinafter "CHR") and gives this honorable court notice of a trial scheduling conflict between the above captioned matter and a case pending in Superior Court of Maricopa County.

Pursuant to a recent order of this court, the within matter has been set for trial to commence on November 29, 2005. William W. Drury, Jr., lead counsel for defendants, is presently set for trial in Maricopa County Superior Court in the matter of Samuel E. Powers v. Taser Int'l. Inc., Case No. CV2003-013457, before the Hon. Paul A. Katz, which will begin on November 15, 2005, and continue into early December. The Power matter has been on Judge Katz' trial calendar for approximately one year. On October 7, 2004, the Court issued its order setting that matter for trial to commence on June 28, 2005. As a result of a trial conflict, the Court issued a further order on June 15, 2005, resetting the trial to November 15, 2005. Concurrently with the filing of this notice, counsel is filing a similar notice in Maricopa County Superior Court in the Powers case. Also concurrently with this filing, counsel is filing a motion to have this matter set for a status conference to discuss the trial conflict and further scheduling.
