DECLARATION OF GREGG H. TEMPLE I am Gregg H. Temple, counsel for Brett D. Leavey, and I state the following based on personal knowledge: I graduated from the Arizona State University College of Law with honors in May 1984 and was admitted to the State Bar of Arizona in October 1984. After three years of public service one year as law clerk for The Honorable William Holohan, Chief Justice of the Arizona Supreme Court, and two years as law clerk for The Honorable Paul G. Rosenblatt, United States District Court for the District of Arizona I have worked continuously in private law practice for seventeen years. I entered private practice in 1987 with the law firm of Harrison & Lerch, which later became Harrison, Harper, Christian & Dichter. My practice focused on the representation of insurance companies in coverage and bad faith disputes and litigation. I was a partner with that firm when it merged with Bryan Cave, LLP in 1993. At Bryan Cave, I represented corporate clients in disputes with their insurers. In July 1995 I left Bryan Cave to practice on my own. I now represent almost exclusively insureds in coverage and bad faith lawsuits against their insurers. Over the past ten years I have frequently been invited to act as a member of the faculty of continuing legal education seminars on insurance coverage and bad faith. I have reviewed the itemization of tasks performed on this case and the estimates of time spent in performance of those tasks and believe both to be reasonable. The estimate of time spent is very conservative as much of the work done on this case could not be recaptured for the purpose of assigning estimates of time. . I declare under penalty of perjury that the foregoing is true and correct. December 22, 2005. ______________________________ __ //Gregg H. Temple//
