DECLARATION
I, Anita Rosenthal, state as follows:
That I am one of the attorneys who represented Brett Leavey with regard to his
lawsuit against UNUMProvident and Provident Life and Accident Insurance, United
States District Court No. CIV-02-2281—PHX—SMM.
That I have been licensed to practice law in the State of Arizona since May of
1980.
That I have read the factual information stated in Plaintiff` s Memorandum in
Support of Plaintiff’ s Motion for Attorneys' Fees and that information is true and
correct.
That prior to opening my own practice, I worked for a firm from approximately
1993 to 1995 which limited its practice to insurance bad faith cases, and related issues on
behalf of plaintiffs. Prior to that, I worked at the Maricopa County Public Defender’s
Office where I tried in excess of 20 cases to verdict. That I was a trial supervisor from
1990 to 1992, where I was in charge of more than 20 attorneys, as well as training new
attorneys in trial practice.
That since opening my own practice in 1995, our practice as been limited to
handling insurance bad faith cases, and related issues, on behalf of plaintiffs.
Undersigned counsel has tried to jury verdict seven insurance bad faith cases, and
has been involved in many other bad faith jury trials, as a consultant. That I have

handled, either as lead counsel or co-counsel, numerous bad faith cases that have resulted
in settlement.
I declare under penalty of perjury that the foregoing is true and correct.
