19 Pending before the Court is Alta’s Rule 55(b)(l) Motion for Default Judgment against
20 Hollander Distribution Systems, Inc. (Doc. # 100). Rule 55(b)( l ), Fed. R. Civ. P. allows the
21 Cle_rk of Court to enter default judgment when a party has failed to appear. Here, Hollander
22 Distribution Systems appeared and defended in this action, including filing and defending
23 summary judgment motions. The fact that its answer was later stricken for failing to obtain
24 counsel does not alter this fact. Therefore, judgment cannot be entered under Rule 55(b)(1).
