I Appellant’s opening brief was due on April 5, 2006. On September 27,
2006, this court ordered appellant to file within 14 days the opening brief, excerpts
_ of record and a motion for relief from default. Appellant did not comply with the
court’s order. `
On November 1, 2006, this Court provided appellant with one final
opportunity to tile the opening brief within 14 days. Appellant was warned that
failure to respond timely to the court’s order might result- in the dismissal of this ·
appeal for failure to prosecute. To date, appellant has not complied with the
