Defendant PNY Technologies, Inc. ("PNY") joins plaintiff in moving to dismiss plaintiff's claims against PNY with prejudice. There is no just reason to delay entry of final judgment in favor of PNY. Accordingly, PNY moves the Court pursuant to Rule 54(b), FED.R.CIV.P., to (1) make an express determination that there is no just reason to delay entry of final judgment in favor of PNY, and (2) direct the Clerk to enter final judgment in favor of PNY and against plaintiff.
